Our delivery charges are calculated according to total order value as follows:

TERMS AND CONDITIONS

These terms and conditions detail your rights and liabilities under law. By making a purchase (either via this Website, by phone or fax, or in person) you agree to be bound by these Terms including Our Disclaimer and Privacy Policy.

Moonsail Ltd is a Limited Company, registered in England, registration no 05209268.

Customers' statutory rights are not affected by any of these terms of trading. We may alter our terms and conditions at any time and without notice.  The conditions displayed on our website at the time of placing your order will apply to your order.

Any disputes arising from our terms and conditions will be settled in accordance with English Law.

Customers' statutory rights are not affected by any of the goods for sale on Our Website.  You will accept that colours, patterns, and sizes shown on our Website are approximate only.  Please be aware that rendition of colours will vary according to your own computer settings and hardware.

2. PAYMENT:

We accept MasterCard, Visa, UK Maestro, Delta, Solo and Electron.  Your statement will show Moonsail Ltd as the payee. 

Prices payable for goods exclude delivery charges – these are shown separately when placing your order.  Prices are subject to change without notice and include VAT.

Payment is required before goods are despatched. If payment is by cheque, (UK bank accounts only) goods will only be despatched once the cheque has cleared.

Prices are exclusive of any import or export duty.

3. CANCELLATION BY YOU

You may cancel your order at any time up to the end of the seventh (7th) working day starting from the date immediately after you receive the ordered goods -  provided said goods are unused, unopened in their original packaging.  In other words, in no worse condition than when you received them.

4. CANCELLATION BY MINIMOONSAILORS LTD

We reserve the right to cancel the Contract if: we have insufficient stock to fulfil your order or we do not deliver to your area or country.   Or if we have reason to believe that you will fail to pay for the goods or that you will not comply with these terms.

5. DELIVERY

We aim to only offer products on our website which we actually have in stock, or those that we can get within a few days. Items in stock should be despatched within 2-3 working days. In the event of a delay, we will inform you of the expected delivery date. If unacceptable to you, we will refund your money straight away. Our standard delivery charges to mainland UK range between £1.95 - £6.25 depending on the weight of the package. This will be by Royal Mail 1st Class signed for delivery. Delivery charges will show at checkout. We also offer a Special 'Next Day' Delivery service which costs £8.00 (Mainland UK only). If you require a next day service, we must have received your order by noon (GMT). This will be delivered by Business Post. A signature will be required on delivery. We are happy to post to EU or other European countries. Postage charges will be applied depending upon the weight of the goods and you should contact us for details.

Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

We do not deliver to PO Box addresses. We also reserve the right not to deliver orders if we believe the address is not secure (eg, a communal postal address.)

For overseas orders, postage & packaging charges are dependent upon weight and are calculated when placing your order.  Please note that you are solely responsible for any import duties and taxes that your order may incur when delivery is to an address outside the UK.

6. RETURN OF GOODS

Under UK  Distance Selling Regulations an EU resident has the right to change their mind and cancel an order at any time within 7 working days of receiving the item(s) without needing to give a reason.  If you want to cancel an order you must advise us in writing that you are exercising this right and return the item(s) to us at your expense. 

In the unlikely event that the goods you receive are faulty or damaged or faulty, we will be happy to replace them or give you a full refund (depending on your preference and stock availability), provided you notify us of the fault in writing within 7 days of receipt.  Otherwise we shall have no liability.  Moonsail Ltd will refund or replace any products if:

They were purchased direct from us within the last 30 days

They are returned to us in their original packaging, and in a resaleable condition

They are returned with the original receipt or Returns form.

Note, customers are responsible for the cost of returning the goods to us - we will not refund any carriage charges paid, unless the item is faulty.

We recommend that you return any goods by registered post.

7. EVENTS BEYOND OUR CONTROL

We shall not be liable for any failure to deliver your goods or any delay in doing so or for any damage or defect caused by an event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

8. PRIVACY

You acknowledge and agree to be bound by the terms of our Privacy Policy.

9. VAT

Children’s clothing up to, and including age 13, are zero-rated for UK VAT purposes.

10.Complaints

In the unlikely event that you have a complaint about any aspect of your dealings with MiniMoonsailors, we will ensure that your complaint will be dealt with fairly, quickly, effectively and confidentially.  Please write to ‘Customer Services’ with details of any grievance. Your complaint will be acknowledged with 5 working days and you will be kept informed of progress. We will attempt to resolve any complaint within 30 days.

11. SECURITY:

We have no way of viewing card information that is entered online. Credit/debit card information for orders placed via the internet is securely captured directly by our payment service provider and is never viewable by us. 

Your card details are transmitted in 128 bit encrypted sessions directly to a secure server, which obtains payment authorisation from the card issuer and processes the payment to our bankers on our behalf. 

Please do not send any card information by email as this is not a secure system. 

12. DISCLAIMER

As covered in ‘Description of goods’ above, the information and media contained on the website about the products available is provided in good faith but colour representation in particular may not be true to life and the listing of an item does not guarantee that stock is available.

We cannot accept responsibility for delivery problems or provide you with a refund if you give inaccurate or incomplete information.

Our website may contain hyperlinks to third party websites. We do not control such websites and take no responsibility for, and will not incur any liability in respect of, their content.  Our inclusion of hyperlinks to such websites should not be taken to imply any endorsement of the products, views, statements or information contained in such websites or the organisation.

We will not be responsible for any injury loss damage or expense you might suffer that is caused by any action or lack of action taken as a result of relying on information contained in this web site, any linked site, or the product labelling.
